I just sent the Govenor my message. I guess now he thinks that I dont much care for Govt. intrusion into our lives. I dont care if he likes my attitude or not(not that he'll ever personally see it). Enough is ENOUGH!

Dear Honorable Governor Deal:

I am writing to voice my concerns over the National Highway Traffic Safety Administration’s Motorcycle Law Enforcement Demonstrations Grant Program and ask for your assistance in stopping the program in Georgia. Although I am not a resident of your fine state this program blatantly discriminates (PROFILES) against motorcyclists and fails to address motorcycle safety.

The NHTSA recently announced a grant program to supposedly address Motorcycle Safety issues. The recipient of the money for the project was the Georgia Department of Public Safety. The Georgia State Patrol is conducting a series of roadside motorcycle safety checks (PROFILING) in accordance with what was outlined in the Request for Applications. The amount of NHTSA funding is $70,000.00. I believe that this is an extravagant waste of taxpayer’s money in this very difficult economy. The motorcycle check points do not address nor decrease motorcycle accidents and instead “profiles” motorcyclists and discriminates against citizens based on their mode on transportation and clothing. I believe that this money could be better spent on motorcycle safety programs.

Motorcycle Safety is an important and growing issue in the United States. Over the past several months Georgia has lost several motorcyclists to inattentive and distracted drivers. The Motorcycle Only Check Points do not address the issues that are killing our motorcyclists. A strong research based motorcycle safety awareness program is needed to ensure our safety and reduce crashes not police check points that target the victims of crashes.

Members of the US Congress recently urged US Transportation Secretary LaHood to suspend the grant program and to concentrate on crash causation and education programs. I am asking for your help in suspending the demo program in Georgia.

Although I am not one of 800,000 or so registered motorcyclists in Georgia I am counting on your help to redirect and redefine motorcycle safety in Georgia. I am planning on riding my motorcycle throughout the Southeast United States this summer. I would love to include the great state of Georgia on my trip but only if it does not include these discriminatory (PROFILING) roadside motorcycle safety checks wasting my time.

The Governors Office of Highway Safety [GOHS] has requested a meeting with A.B.A.T.E. of Georgia's Legislative Director, Linda Allen and the State Director Dan Forrest.

This meeting is to discuss the concerns that A.B.A.T.E. and our membership have regarding the reported Motorcycle ONLY Safety Check Stops.

Your calls and letters are in part responsible for this meeting. Your voice is being heard in Atlanta.

We're singled out because we're easy to spot! It is a little too easy for GA to setup these checkpoints. But not unlike, a drunk stop seen on Holiday weekends. Best advice, make sure you follow the DMV laws from your state, and have proof, if they challenge your right to not have turn signals, etc.

But understand, there is no legislature that states they can't do this, be careful, to those of you that want this in writing, as it leads to Bigger government, hence 'Big Brother', and loss of freedom, both personally, and privately.

So fighting it when it happens is the best approach, as long as your legal in your state. So what if you get stopped for 20-30 minutes to have a safety check. I know that after riding a few hundred miles, my backside could take a break

And with that then Delta, United, etc, should have the right to set up their own check points and profile for terrorists like Israel does. It is their airlines after all, isn't it?

I think your missing the point. The Airlines are private industry, conforming to government regulations(FAA), we have checkpoints (TSA). GA is government, and a safety check is merely they right to exercise the enforcement of that right.

It's our right to voice our opposition to said 'checkpoints'. As I mentioned early, I don't approve of the timing of these but, they are similar in nature to 'drunk stops' for DUI drivers during Holiday season. So really where is the harm?

We could spend all day, spinning this to suit our positions. I don't agree with the timing, but I understand the premise. As long as your bike passes the safety check, where's the harm? As riders to combat this type of focused attention is to be familiar w/ GA DMV law concerning motorcycles, basically what they can, and can't cite us for. For example, if they have a helmet law, hang one off your sissybar, or saddle bags until you hit the GA line, then put it on. Saves me a ticket, cause odds are, they are more than the price of a $50.00 DOT half shell.

So my position is 'don't give them a reason', 30 minutes of mild disruption is better than a $100.00+ ticket, because I gave them the 'One Finger Salute' metaphorically of course.

Like the old Boy Scout motto - 'Be Prepared, son. Be Prepared'

If they don't make any money at these 'checkpoints' odds are they will stop doing it, also succumbing to public pressure helps too.

Public pressure can topple governments, so we can give GA state government a little nudge to remind them, we won't stand for this type of 'focused attention'.

In the United States, the citizens have natural and self-evident rights. The 4th Amendment of the Constitution addresses unreasonable searches and seizures without probable cause in citizens' person, house, papers and effects. US Courts have ruled that personal vehicles are effects.

As far as I am concerned, if a law enforcement officer observes a vehicle driver/rider that is exhibiting "probable cause" such as an open-contained, erratic driving, expired plates, safety violation, etc., then they have reason to pull him over and investigate.

But for law enforcement to set up any checkpoint, whether profiled or non-profiled, is unconstitutional.

Even if they find zero-violations, they have already made money off of the checkpoint. The state law enforcement agencies operate these checkpoints to keep the NSTB grant money in-house by paying their leaders and officers "overtime pay". The $70,000 in Federal Grant money is US Citizens' taxpayer money going into the pockets of the Georgia State employees at an overtime rate.
