Please read this link in the Sportsterpedia. It explains what you are asking:
Wet Sumping

If you are not dripping oil, that's great.
But it isn't because of an EBS (don't know where that term came from).
It's because your crankcase pressure is stabilized.
You can remove your EBS and revert to new OEM parts and you won't leak.
You can keep the EBS and remove the breather valve(s) and your EBS will now leak.

I still learn something new from this forum every day. This is good info and obviously, I ASSUMED that the S&S engines were based on current EVO engines. Thanks for the correction and update.

Now, my next question since we're on the subject of oil filter vs oil pump location, does it matter if the oil filter on the rubbermount Sportsters has an anti-drainback valve?

No, there is no need.
But thank you. I need to add this to the pedia.
The oil tank sits higher than the oil filter housing.
So if any oil did drain back. Where could it drain to?
We all know Sportsters have a problem with oil gravity draining into the engine when the engine is shut off and it sits for a while.
This is due to either a worn check valve or worn clearances in the oil pump.
So, oil will be pushed against the filter at all times without a drainback valve in the filter.
No need for the drainback valve.
