21801.

(a) The driver of a vehicle intending to turn to the left or to complete a U-turn upon a highway, or to turn left into public or private property, or an alley, shall yield the right-of-way to all vehicles approaching from the opposite direction which are close enough to constitute a hazard at any time during the turning movement, and shall continue to yield the right-of-way to the approaching vehicles until the left turn or U-turn can be made with reasonable safety.

(b) A driver having yielded as prescribed in subdivision (a), and having given a signal when and as required by this code, may turn left or complete a U-turn, and the drivers of vehicles approaching the intersection or the entrance to the property or alley from the opposite direction shall yield the right-of-way to the turning vehicle.

A violation of this section is a noncriminal traffic infraction, punishable as a moving violation as provided in chapter 318.

Really?

A while back I was stopped in a left turn lane, when the green arrow appeared I paused for a second to make sure the cross traffic stopped. Before I moved a cage passed me on the left, going west in the eastbound lane, and would have hit me broadside if I had attempted my turn.


I would have been dead, or seriously injured, but who would have been at fault?

It is my understanding that in watercraft, aircraft and motor vehicles that the overtaking vessel, aircraft, motor vehicle must yield to vehicle being overtaken. This is world wide, not incident specific. But regardless, I ride defensively and assume everyone around me is an idiot. Been avoiding idiots for over 50 years with an occasional user error.

Since this is a Sportster forum, analogy to boats may not be appropriate Now, if this were a BT forum...

However, all joking aside, both the US and Canada require a boat in a crossing situation to yield to an area between dead ahead and 112.5 degrees to the right.

In an overtaking situation, "any vessel overtaking any other vessel must keep out the way of the vessel being overtaken" in the US. Canada advises the vehicle being overtaken to not change course.
