Question Is it the tank or is it the seat?

The small "clip" that holds the tank trim on my '04 sporty is exposed where the tank and the seat meet. I searched through past threads and couldn't find a thread on this issue. This is my first Harley and I'm a total noob to the site Any ideas or fixes?

If you are looking at the point at which the seat ends and the tank begins, it looks as if the seat is too short. You see the fastener that holds the end of the tank trim in place. It was like that when I bought the bike (used). I just keep forget to ask the guys at the dealership and tend to overlook it the rest of the time.
